1 Congregation Shaarei Shamayim
Letter sent to 1500 households in July 2006 by Congregation Shaarei Shamayim
solicited interest in a condominium project that would include space for the
congregation at 2490 North Druid Hills Road. The proposed condominiums are
one- and two-bedroom units. The property is currently zoned R-85 (single-family
residential) with a Special Land Use Permit for a place of worship.
2 Yeshiva Ohr Yisrael
On September 14, 2010, Yeshiva Ohr Yisrael received a conditional special
land use permit (SLUP) from the DeKalb Board of Commissioners to build a
place of worship and a dormitory (see
final list of conditions attached to SLUP). The 3.74 acres property formerly owned by the Gatchell Home and zoned
R-85 was purchased by Ohr Yisrael, a private high school for boys. In 2007,
DeKalb County Board of Commissioners (BOC)
approved a limited 4-year SLUP with
conditions that allow interior renovation of existing structures but did not
permit construction of new buildings. Ohr Yisrael applied to DeKalb
County for a SLUP to operate a synagogue (place of worship)
with an accessory high school and dormitory (approximately 60-80 male
students in 9th to 12th grades (site plan
dated 2006).
Yeshiva Ohr Yisrael's property has vehicular access through a driveway on
Holly Lane. The property is bordered by homes on Holly Lane; Kittredge Park;
and vacant DeKalb School property. 3 Green Street Development
Application for land use change and rezoning to build 21 homes in place
of 3 existing homes at 2527, 2533, and 2545 North Druid Hills Road approved
by the Board of Commissioners. Conditions were attached to the rezoning. See
the
final list of conditions attached to the rezoning. Since the rezoning of
this property, it has been sold by the original homeowners to a developer
other than Green Street Development for $1.9 million and has once again been
listed for sale at $2.8 million. 4 Young Israel of Toco Hills
On January 26, 2010, DeKalb BOC approved conditional SLUP for Young
Israel of Toco Hills for a place of worship on property fronting LaVista
Road between Merry and Christmas Lanes. The site plan submitted with the
SLUP application showed a 15,000 sq. ft. building is planned for the 3.37
acre property. See

5 100-acre project proposed for Briarcliff and North Druid Hills Roads by
Sembler Company
The Sembler Company presented its preliminary plans to the public on June
27. Their plans include 103 acres, 1.5 million square feet of retail, 3
department stores, 22 restaurants, 300,000 square feet of office space, 300
hotel rooms, and 3,700 residential units. At least 1,000 of the residential
units are slated to be workforce low-income housing. Each of the three main
streets in the development are 1 mile long. See

The project would require review by the Atlanta Regional Commission
because of its size. in addition, since the current land use and zoning does
not entitle the development of this property on the scale proposed by
Sembler, DeKalb County commissioners would need to approve a change in land
use and zoning for the project to be built as shown.
6 The Druid, high-rise residential condominium and retail
project at the corner of Briarcliff and North Druid Hills Roads
North Druid Development is seeking approval for a mixed-use project at
the corner of Briarcliff and North Druid Hills Roads. The developer is
requesting a rezoning and and use change to replace the current Citgo
station and Lutheran Church with a free-standing pharmacy, a 12-story
residential condominium tower, street-level retail stores, and 3-story
underground parking garage. The rezoning and land use application was
heard by the Board of Commissioners on November 20 and decision was deferred
for two months. Merry Hills Homeowners Assn. and two other neighborhood groups
spoke in opposition to the project. 7 2166 LaVista Road
MHHA was notified in late 2006 by the owner of 2166 LaVista Road that he will seek county
approval to remove the conditions that were attached to his property more
than 10 years ago. At that time, Merry Hills neighbors opposed the change
from a residential to office-institutional zoning district for this property
and 4 others at 2160 to 2184 LaVista Road (known collectively as the Farris
property). Use of the property is limited by a set of conditions that
prevents construction of new buildings and provides buffers for the
neighboring homes. The property adjoins homes in the Weatherstone Townhomes
and homes on Merry Lane.
8 Temima High School
Temima High School and Congregation Beth Jacob (BJ) received a
special land use permit (SLUP) from the DeKalb County Board of Commissioners to construct an accessory girls’ school on a
2-acre parcel next to BJ at 1839 LaVista Road. The parcel is currently owned
by the Atlanta Scholar's Kollel. The existing building will be demolished
and a new building constructed with a total square footage of about 25,000
sq. ft. Conditions of rezoning require relocation of the building out of the
75-foot stream buffer, removal of kudzu, and a variance for reduction of
parking to accommodate relocation of the building out of the stream buffer. See the
